A buyer’s premium will be added to all purchases and is as follows on all regularly scheduled weekly online auctions:

18% BUYERS PREMIUM for each item. If the buyer pays their invoice with cash or wire transfer, then we waive 3% of the buyer's premium, which makes it 15%. The 3% buyer's premium discount is available only if the invoice is paid in full within 10 days of the auction date.

All high bids are considered legal binding contracts and all sales are final. All items are sold "as is where is", with NO guarantee, warranty, or possible refund written, expressed, or implied. The working/running condition of an item may not be known and may not always be listed in the items description. Sometimes we do know and list the condition of the items, but many times do not. Please note that all sales are final regardless of the purchase items condition, unless the discretion of a 321FinalBid Manager deems differently.

All items sell AS IS - WHERE IS WITH ALL FAULTS and with no warranty of any type expressed or implied as to the merchantability or fitness for any particular purpose of any goods offered in this sale. All sales are made on an AS IS - WHERE IS WITH ALL FAULTS basis. No bids can be withdrawn once submitted before, during or after the auction for any reason. BUYER agrees that these terms as well as all other terms set forth below, can be amended or revised only in writing, signed by the auctioneer. Posted closing times and displays of 321FinalBId’'s current time are approximate. 321FinalBid reserves the right to close early or extend auctions at any time at its discretion. It is strongly recommended that bids be placed early to avoid losing out due to an ill-timed, last minute bid. All times based on Eastern Standard Time. Dynamic bidding - The dynamic bid on this website is a feature that does NOT allow an item to sell at the end of the auction until there is 10 minutes of bidding inactivity. Example - An item is bid on at 7:50pm. An auction is scheduled to close at 8:00pm. When this bid is placed the ending time will automatically extend to 8:10pm. When another bid is placed at 8:01 the auction will extend until 8:20 PM. This will give the bidder 19 minutes to place another bid. If no bids are placed this auction will conclude at 8:20 PM. The key to your dynamic bidding feature is that the auction extends from the preset closing time in 10 minute intervals, NOT 10 minutes from when you placed your bid.

The first picture for most items are a factory picture and is meant for illustration purposes only. Please rely on other pictures and item description, for actual condition and included accessories or parts.

Item conditions:

New – Retail Ready, New in box, includes manuals, remotes, accessories where applicable.

Unused – Opened, does not appear to ever be used, may not be in original packaging, may not include manuals, remotes, or accessories.

Slightly Used – Opened, maybe used once or twice, minimal signs of wear.

Used – Item has been visibly used, typically works as it should, see description for additional details.

Parts or Repair – Items are in non-working condition and need to be repaired or used for parts.

Store Return - Returns were sold to a customer, who then physically brought the item back to a store. Reasons for returning a product may not have any correlation to its usefulness, and as a result that product may be in fine working order. Returns may have some operational and/or cosmetic problems. Depending on a company's return policy, these items may also reflect a measurable amount of use. They may or may not come in original packaging and may not have any of the advertised documentation or additional parts and/or accessories. Returns can exhibit a wide range of individual product and package conditions that can differ substantially from the original manufacturing. These items are not tested for function.

Salvage - Salvage assets are intended for professional buyers, as most can be used only for parts. These assets are offered "as-is, where-is" with no returns, guarantees, or claims as to be working condition

A bid may be placed for any amount equal to or greater than the current required bid amount, which means your bid amount is not required to be an increment of the posted bid increment.

Example:

Current bid at $10.00 with a bid increment of $2.00.

Minimum bid required would be $12.00.

A bid may be placed for any amount equal to or greater than $12.00.

The bid amount is not required to be in increments of $2.00; therefore a bid could be placed for $17.00 or $76.00 or whatever amount you wish to bid as long as it is equal to or greater than the minimum bid required.

The winning bid may end up at any amount. It may not be divisible by the stated increment. The winning bid will be the highest

All Auctions must be paid and picked up within 7 days of the auction.

All items purchased on the regular online auctions are to be paid for and picked up within 7 days from the auction date. After this 7 day period if your invoice has not been both paid for and picked up, an automatic $2 per lot/per day storage fee will be added to your invoice and will be subject to being resold at the high bidder’s expense. After 10 days from the date of the auction (NOT from the date paid or picked up) no adjustments can be made on the invoice with regards to any item purchased on the auction and upon this time full payment is also still required regardless of the condition or the availability of the item.

You can place bids on an item before the auction starts, this is especially helpful if you will not be available on the day of the auction.

When an item status shows as “Pre-Bidding” this simply means that bids placed are not displayed on the auction site until the date the auction is scheduled to open.

Although there may actually be pre-bids placed on the item, an item in pre-bidding status will show # of bids placed as 0 and the current bid (required bid) will show as the opening bid.

You may place a pre-bid through the same process as normal bidding. You can monitor & view your bidding activity on items in pre-bid status from your Watch List.

When you place a pre-bid, if you are notified that your bid is not higher than another user’s pre-bid this means that another bidder(s) has already placed a pre-bid equal to or higher the amount of the pre-bid you are attempting to place. You will need to raise your pre-bid if you want to be in the winning position.

All pre-bids will be tallied and shown when the auction actually begins.

Cash - Only if the invoice is paid in full within 10 days of the auction date.

If an item is not described or pictured properly, 321FinalBid offers a 48 hour refund policy. Please use the description and pictures to make your bidding decision. Keep in mind that the factory picture cannot be used as a reason for refund as it is used for illustration purposes only.

If for any reason the buyer fails to remove any purchases within the time specified, the Auction Co. shall have the right but not the obligation, in its sole discretion, to resell, discard or remove and store said purchase at the buyers sole risk and expense (storage costs will be charged - per day - per item - other costs additional), without waiving any rights that 321FinalBid or seller may have against buyer. Storage charges will be the responsibility of the buyer (after removal period). If the purchases have not been removed within the 10 day time period, these items will be considered abandoned and 321FinalBid reserves the right to relist/resell any and all those items considered to be abandoned or forfeited when invoice is paid in full but not removed completely from auction location within 10 days of auction.

This means that an item's sale is contingent upon receiving the approval of any Bank, Court, Trustee or Lien Holders affiliated with that particular piece. Please call (248) 795-5171 for the Approvals on all items that sell and we will be happy to assist you.

All bidders will be subject to 6% State of Michigan Sales Tax. If you are tax exempt, provide our office with the documentation required for exemption.

Sales tax is calculated on total sales price which includes Buyer's Premium (therefore Buyer's Premium is also taxable). Please refer to further explanation under the Other Info/Links section of each item.

 All items are sold “AS IS WHERE IS.” Currently we do not provide shipping.

PROXY BIDDING

Using the Proxy Bid system, a bidder can place a maximum bid at any time and go about other tasks. The system will automatically outbid other bidders up to the maximum amount of the Proxy Bid. Any time there are bids placed against the Proxy Bid, the system will outbid the new bid by the increment used for that item. As the Proxy Bid cannot bid more than agreed, there are situations where the increment may be less than the usual increment.

Example:

At any time you can place a maximum bid of whatever amount you are willing to pay. To initiate the maximum bid, you must bid at least $2 more than the current amount. Once your maximum bid has been placed, You will remain the winner up to your maximum bid.

Example:

Bidding on a tattoo kit is at $5.

Bidder 1 places a $10 bid. They outbid the current bidder at $7 and will remain the winner until $10

Bidder 2 places a $9 bid. Since Bidder 1's maximum bid is greater than the $9 bid placed by Bidder 2, Bidder 1 remains the winner. The system will attempt to go up the $2 increment, but cannot place a bid for more than the amount they agreed to pay, so it goes up to their maximum of $10.

Also, if there happens to be a Tie placed by two Proxy bidders, the Bid that is in first wins.

321FinalBid Reserves the right to charge any credit card registered with your account the total invoice amount due including storage fees, buyers premium, taxes and bid amount or an amount equal to 20% of the total purchase price plus any buyers fee as a non-refundable restocking fee (minimum $25.00 charge.) This non-refundable restocking fee will be applied when invoices are not paid in full within 10 days of the auction date.

Note that the purchase price is the sum of the bid price, buyer’s premium, buyer's fee, and sales tax if applicable.

At which time, all items are considered to be abandoned and/or forfeited to 321FinalBid. 321FinalBid reserves the right to relist/resell any and all items considered to be abandoned or forfeited when invoice is not paid in full and removed completely from auction location within 10 days of auction. We do not accept partial payments. Invoices must be paid in full. All payments must be made in U.S. Funds.
